Privacy Policy – Informativa sul trattamento dei dati personali ai sensi dell’art.13 del Regolamento UE 2016/679
Premessa
Colella Group S.r.l., con sede legale in Via Arangio Ruiz n.44, 80122 Napoli, Partita IVA 09730371003, Codice Fiscale 09730371003, in qualità di Titolare del trattamento (di seguito “Titolare”), ai sensi del Regolamento UE 2016/679 (di seguito “Regolamento”), considera la privacy e la tutela dei dati personali un pilastro fondamentale nella propria attività.

La invitiamo, dunque, prima di comunicare qualsiasi dato personale al Titolare, a leggere con attenzione la presente Privacy Policy perché contiene informazioni importanti sulla tutela dei Suoi dati personali.

Tipologia di dati trattati
A seguito della navigazione del Sito, La informiamo che Colella Group S.r.l. tratterà i Suoi dati personali che potranno essere costituiti da: un identificativo come il nome, un numero di identificazione, un identificativo online o uno o più elementi caratteristici della Sua identità fisica, economica, culturale o sociale idonea a rendere il soggetto interessato identificato o identificabile (di seguito solo “Dati Personali”).
I Dati Personali trattati attraverso il Sito sono i seguenti:
Dati di contatto quali nome, cognome, sesso, data di nascita, email, telefono e indirizzo cui ricevere i beni oggetto degli ordini di acquisto.
Potrebbero essere trattati dati particolari da lei liberamente forniti in una mail di richiesta informazioni o tramite il modulo di contatto del sito.
a. Dati di navigazione
I sistemi informatici e le procedure software preposte al funzionamento del Sito acquisiscono, nel corso del loro normale esercizio, alcuni Dati Personali la cui trasmissione è implicita nell’uso dei protocolli di comunicazione di Internet. Si tratta di informazioni che non sono raccolte per essere associate a interessati identificati, ma che per loro stessa natura potrebbero, attraverso elaborazioni ed associazioni con dati detenuti da terzi, permettere di identificare gli utenti. In questa categoria di dati rientrano gli indirizzi IP o i nomi a dominio dei computer utilizzati dagli utenti che si connettono al Sito, gli indirizzi in notazione URI (Uniform Resource Identifier) delle risorse richieste, l’orario della richiesta, il metodo utilizzato nel sottoporre la richiesta al server, la dimensione del file ottenuto in risposta, il codice numerico indicante lo stato della risposta data dal server (buon fine, errore, etc.) ed altri parametri relativi al sistema operativo e all’ambiente informatico dell’utente. Questi dati vengono utilizzati al solo fine di ricavare informazioni statistiche anonime sull’uso del Sito e per controllarne il corretto funzionamento, per identificare anomalie e/o abusi, e vengono cancellati immediatamente dopo l’elaborazione. I dati potrebbero essere utilizzati per l’accertamento di responsabilità in caso di ipotetici reati informatici ai danni del sito o di terzi: salva questa eventualità, allo stato i dati sui contatti web non persistono per più di 24 mesi.
b. Speciali categorie di dati personali
Non sono trattate queste tipologie di dati.
c. Dati forniti volontariamente dall’interessato
Nell’utilizzo di alcuni Servizi del Sito potrebbe verificarsi un trattamento di Dati Personali di terzi soggetti (es. figli minorenni e non) da Lei inviati a Colella Group S.r.l. Rispetto a tali ipotesi, Lei si assume tutti gli obblighi e le responsabilità di legge. In tal senso, conferisce sul punto la più ampia manleva rispetto ad ogni contestazione, pretesa, richiesta di risarcimento del danno da trattamento, ecc. che dovesse pervenire a Colella Group S.r.l. da terzi soggetti i cui Dati Personali siano stati trattati attraverso il Suo utilizzo delle funzioni del Sito in violazione delle norme sulla tutela dei dati personali applicabili. In ogni caso, qualora fornisse o in altro modo trattasse Dati Personali di terzi nell’utilizzo del Sito, garantisce fin da ora – assumendosene ogni connessa responsabilità – che tale particolare ipotesi di trattamento si fonda su un’idonea base giuridica ai sensi dell’art. 6 del Regolamento che legittima il trattamento delle informazioni in questione.

Finalità del trattamento
I dati personali saranno trattati, dietro specifico consenso dell’interessato (ove necessario), per le seguenti finalità:

Consentire l’erogazione dei servizi richiesti quali:
Gestione ordini di acquisto (con o senza creazione “account personale”);
Iscrizione alla newsletter (con solo inserimento mail o dall’account personale);
Richiesta generica di informazioni (incluse eventuali offerte);
Assolvere eventuali obblighi di legge, contabili e fiscali.
Base giuridica e natura obbligatoria o facoltativa del trattamento
La base legale del trattamento di Dati Personali per le finalità di cui ai punti a), b), c), è l’art. 6(1)(b) del Regolamento in quanto i trattamenti sono necessari all’erogazione dei Servizi o per il riscontro di richieste dell’interessato. Il conferimento dei Dati Personali per queste finalità è facoltativo ma l’eventuale mancato conferimento comporterebbe l’impossibilità di attivare alcuni dei Servizi forniti dal Sito. La finalità di cui al punto d), rappresenta un trattamento legittimo di Dati Personali ai sensi dell’art. 6(1)(c) del Regolamento. Una volta conferiti i Dati Personali, il trattamento è invero necessario per adempiere ad un obbligo di legge a cui la Colella Group S.r.l. è soggetta.
Per i trattamenti effettuati ai fini di invio diretto di proprio materiale pubblicitario o di propria vendita diretta o per il compimento di proprie ricerche di mercato o di comunicazioni commerciali in relazione a prodotti di Colella Group S.r.l. analoghi a quelli da Lei richiesti, Colella Group S.r.l. può utilizzare, senza il Suo consenso, gli indirizzi di posta elettronica e di posta cartacea ai sensi e nei limiti consentiti dal provvedimento dell’Autorità Garante per la protezione dei dati personali del 19 giugno 2008; la base giuridica del trattamento dei Suoi dati per tale finalità è l’art. 6(1)(f) del Regolamento.
In ogni caso, ai sensi dell’art. 21 del Regolamento, Lei ha la possibilità di opporsi a tale trattamento in ogni momento, inizialmente o in occasione di successive comunicazioni, in maniera agevole e gratuitamente anche scrivendo al Titolare o al DPO ai recapiti sopra indicati, nonché di ottenere un immediato riscontro che confermi l’interruzione di tale trattamento (art. 15 del Regolamento).

Destinatari dei dati personali
Esclusivamente per le finalità sopra indicate, i dati saranno resi disponibili, oltre che al personale interno autorizzato, anche a collaboratori esterni e/o fornitori di servizi incaricati del loro trattamento il cui elenco è disponibile presso la sede del Titolare.

I dati personali non verranno diffusi, con tale termine intendendosi il darne conoscenza a soggetti indeterminati in qualunque modo, anche mediante la loro messa a disposizione o consultazione.

Criteri di Conservazione dei dati
I dati saranno conservati da Colella Group S.r.l. per tutto il periodo necessario all’erogazione dei servizi richiesti, per i tempi successivi necessari ad adempiere alle norme di legge, nonché per i tempi necessari per permettere un’eventuale difesa e tutela in giudizio.

Trasferimento dei dati in Paesi Extra UE
Non è previsto il trasferimento dei dati in Paesi terzi al di fuori della comunità europea.

Processi automatizzati di profilazione
I dati conferiti non sono oggetto di processi decisionali automatizzati.

Diritti degli interessati
L’interessato ha diritto ad esercitare i propri diritti secondo quanto previsto dagli artt.15-22 del Reg. UE 2016/679. Pertanto, i soggetti cui si riferiscono i dati personali hanno il diritto in qualunque momento di ottenere la conferma dell'esistenza o meno dei medesimi dati e di conoscerne il contenuto e l'origine, verificarne l'esattezza o chiederne l'integrazione o l'aggiornamento, oppure la rettificazione, la cancellazione, la portabilità, la trasformazione in forma anonima o il blocco in violazione di legge, nonché di opporsi in ogni caso, per motivi legittimi, al loro trattamento.

Con riferimento all’account personale l’interessato può, accedendo al suo profilo, modificare/aggiornare le informazioni che lo riguardano e, se necessario, richiedere la cancellazione del proprio account utente inviando una mail ai contatti indicati.

eRecruiter is a a recruiting software for websites of eRecruiter GmbH, OK Platz 1a, 4020 Linz, Austria (hereinafter "eRecruiter"). On our website, we have integrated iFrames from eRecruiter, which allow website users to apply to vacancies within our company group.

When you visit a website which includes an eRecruiter iFrame, your browser will establish a direct connection to the eRecruiter servers and load the iFrame from there. 2.2.4 Newsletter

With the following information, we will inform you about the contents of our newsletter as well as the registration, dispatch, statistical evaluation procedure and your right of objection. We send out newsletters, e-mails and other electronic notifications with promotional information (hereinafter "Newsletter") subject to the consent of the recipient or a legal permission.

The registration for our newsletter is handled through a so-called double opt-in procedure, which means you will receive an e-mail after your registration, in which you will be asked to confirm your registration once again. According to the assumed user interests, relevant advertisements are then shown to the internet user. This allows advertisements to be delivered as targeted as possible. Otherwise, neither our tracking services, nor does the tag management tool "MasterTag" provided by AWIN to its customers collect data for these purposes. The tracking codes used by the MasterTag through our Publishers may use cookies for purposes of behavioural advertising.  Similarly, Advertisers and Agencies may use the MasterTag for their own data collection purposes.  Our involvement in this data collection is limited to the fulfilment of instructions we receive from Advertisers and Agencies, who are the sole controllers of this data.

2.3.4 General

The above processing is undertaken in the pursuit of our legitimate interests of operating our affiliate networks, generating revenue and fraud prevention.

We control how data is processed for the purposes of tracking alongside the Advertisers and Publishers which use our network from time to time.

 

3 Processing and use of personal data

We use personal data provided by our clients only for administrating and providing our technologies and services, for responding to clients’ enquiries and, where applicable, executing the contract between a client and AWIN. We store personal and any other kind of data strictly in compliance with applicable data protection and privacy legislation and our contractual duties, and will prevent unauthorized access to data to the best of our abilities.

Provided you have given your consent or have not objected – where legal provisions allow so – we may use your personal data for advertising and market research. By registering with our Network you give your consent that we may contact you via telephone, via mail and email in order to provide you with information on AWIN offers. You may withdraw your consent at any time.

We may transmit your data to our subcontracted service providers, both in and out of the EU, but only if we contractually assigned these to process data on our behalf and, both ourselves and the subcontracted service providers comply with all requirements of commissioned data processing regulations pursuant to the German law on data protection. Data is stored by us within the European Union and the European Economic Area.

In order to fulfil our contractual obligations we may transmit your data to companies that we control and subsidiaries of such provided that these companies are subject to this Privacy Policy or privacy guidelines ensuring at least equal protection for your data.

We do not transmit data to other third parties unless you have given your consent thereto or the transmission is made to state institutions on the basis of mandatory national legislation.

Some of our tracking involves the creation of a profile of each user.  The profile is separate to any profiles used  by Affilinet for its online behavioural advertising and does not reveal users by name or contain any information about their online behaviour.  The profile is used to allow us to understand which devices are associated with that user..

 

4 Data security

AWIN takes all technical and organisational security measures required to protect your personal data from loss, unauthorised disclosure or other forms of misuse. Data is stored in a safe environment that is not open to public access. Your personal data may be encrypted before transmission in certain cases (e.g. processing your login data). This means that – support by your browser provided – communication between your device and our servers will include recognized encryption measures.

Our staff has been trained in privacy matters and in dealing with data and information, which they gain access to in a responsible manner.

Please be aware that should you contact us via email, confidentiality of information therein may not be ensured. Third persons may have access to contents of emails.
